It’s going to come down to Trump’s team saying he had the power to declassify documents, and he had a standing order for anything he took home to be declassified. The opposing side is going to say they weren’t aware of this, and that he doesn’t have the authority to issue such a standing order. It’s going to be up to the judge to decide this whole thing, which can be a blessing or a curse depending on how biased the judge is.
Do these DoJ investigators have the security clearance to see these “supposed” top secret files? As President, Trump had the clearance. If they were declassified as Trump said and had the authority to do so, then the FBI can view them. If not, then the FBI agents may be violating federal laws by viewing them.
