Lawyer for teacher shot by 6-year-old says school 'failed to act' after warnings 



The lawyer of Abigail Zwerner, who was shot by her 6-year-old student at a Virginia elementary school, announced a lawsuit against the school for failing to act after multiple teachers warned that the student had a gun. Diane Toscano said the administration ignored the warnings and failed to act accordingly.

This is why public schools are failing – rampant organizational failures in a bloated institution with no safeguards or controls, shabby and misguided performance metrics, and administrators dealing with a new generation of very troubled children that shouldn't be in school. Some needs to investigate the rise of a growing number of aggressive, violent, bullying children in America and what's being done about it before they grow up to do more harm.

  4. After all the school shootings, I don't understand that a teacher with such a suspicion listened to the administration. There needs to be legislation to protect teachers that act alone if they have just cause.

  6. kids become criminals because the rules say you can't touch them. in my days kids were spanked and hit on the hand with a ruler, now you just have to get shot, that is america for you, anyone can carry a gun a knife or any other type of weapon. bravo america!

  7. I don't get it. Why have we not seen the parent(s) of the kid? I find no mention of any consequences for the parent or parent. Initial reports said the shooting was intentional. What!!! Only thing I heard is the mother bought the gun legally, and apparently made it accessible for her kid. I support the 2nd amendment but with great power comes great responsibility I heard somewhere. And there is not much of that these days. Sue the socks off that parent..

I and every every parent I let know about it will sue the school district, the 6 yr old's whole family, the State of Virginia, the United States of America…and, and everybody in it!!

  12. Shooting a teacher is unacceptable & inexcusable. But, making no excuse for behavior. There's still 1 burning question in my mind. Why did that kid hate that particular teacher so much? There may or may not be more to this story.

  14. In my old school, we had four incidents that involved a gun or a knife and the school did nothing. They also had rules in place that made it harder for teachers to discipline students who act violent and one of them told the teachers, "We know the rules and you can't do anything".

  15. That admin must be accountable for every dollar to be awarded and be barred from any school administration or contact with any school at any level. Let them sell shoes!

  22. In my opinion, both the school and boys parents need to be held liable especially the parents.

    In my opinion, when school officials couldn't find the gun because this six year old boy hide the gun.

    This boy needs mental health services because a six year old does not take a gun to school to shot a teacher intentionally. That's what this boy told police, he shot the teacher intentionally.

    Many times children with mental illness or serious mental illness do not get the services that they need.(My opinion)

    In my opinion, services needs to be out in place ,if not this boy will continue this behavior. For parents who need to be at school every day says alot of this six year old boy's behavior.

    Everything is a lawsuit! The kid was 6 years-old. America has to FIGURE OUT what is going on with our kids, not sue everyone.

  25. You have to sue to have anyone take things seriously. I hope the teacher gets enough to retire.

  26. Parents of special needs kids need to do better in cases like these. It’s not just the schools. Often times parents will deny their kids have a problem and are quick to sue for discrimination OR they aren’t helpful (ie. Wasn’t someone supposed to supervise the kid because of his behavior issues?).

    Did they start hybrid classes because of inclusivity? I know some schools mix special needs classes with regular classes now.

  29. The kid with the gun was obviously bragging to other children that he had it and they tried to snitch on him but were ignored by adults.

  32. The actions of the school, and law enforcement as well as the statement from the child's parents paints a portrait of privilege not afforded to Swarthy families. That child went to school to harm his teacher and the school didn't care the pupil brought a loaded side arm into the classroom and concealed it from inspection. Why do parents send their children to American schools?
