  3. Whichever you’re side on, it’s all about battle of evidences, and accountability. No one is above the law.

  4. Bringing an old, legally flawed, and relatively trivial NY case could make it more difficult to hold Trump accountable for those far more serious acts attempting to overturn the election in Georgia and the January 6 insurrection.

    Both the misdemeanor and felony charges under NY 175.10 require that the defendant acted with “intent to defraud.” This is significant.

    From NY case law, in People v. Saporita, the appellate court noted that the crime required “intent to defraud,” and that the trial court had charged the jury: “The term defraud means to cheat or deprive another person of property or a thing of value or a right.” Intent will be difficult to document, as well as injured party deprived of money or property by making false entries in the books of a private company.

  20. I think a lot of evidence came to light with the release of Trump's taxes, and the books of the Trump Organization. Before that it was probably borderline, and many of the documents were not available.
