  10. Texas judge's ruling applied to the 2000 FDA approval. FDA could simply issue a 2023 reapproval of the drug, based on tons of existing safety and effectiveness data from the past 23 years.

  14. Conservatives lie that repeal of Roe v. Wade was about making abortion a state's rights issue. They are just fine with a federal ruling, but for banning abortion. The problem is conservatives want to strip a right and replace it with an obligation. And it's not about protecting "unborn lives", it's about a sick and creepy compulsion to control women by impregnation. Conservatives are a bunch of twisted freaks.

  15. The abortion lobby has always realized that abortion itself is indefensible. This has forced them to argue that whether abortion is the deliberate killing of a living human being or not, is unrelated to the question of whether it should be legal. In short, they have to divert attention toward the philosophical concepts of “choice” and “who decides” because they can’t afford for the public to look at what’s being chosen and decided.

  19. Since the high court is still very business friendly and pro-big pharma, I can't see them upholding a Texas judge's ruling, which will invalidate nationwide FDA-approval of mifepristone. If the Texas judge's decision was based on credible medical evidence; an imminent safety risk; or a colorable procedural or legal error by the FDA, then that would grounds for the judiciary overturning an administrative decision of the FDA.

  20. Can we all chip in and purchase an injunction against the Texas loony judge? Now that it's out in the open maybe SCOTUS will be good enough to provide us with a price list.

  36. Now? We're going to find out if SCOTUS is "legally conservative" or "politically conservative". If the former? They're not going to want courts to routinely wade in on FDA scientific judgements – particular those of long standing. If the latter? Then Roberts could be presiding over the end of an institution. The overwhelming US majority isn't going to tolerate having extreme policy imposed by random federal judges.
