The problem with the feds and the reason why it will stay illegal at the federal level is due to the fact that back in the 60's the US entered into an agreement with a bunch of other countries to let the United Nations do the scheduling of elicit drugs and each signatory nation agreed to enact laws to prosecute criminals that should possess, smuggle or sell said substances. Any country that refuses to prosecute these people can suffer large fines if another signatory nation files a complaint. This was done with the intention of making international interdiction efforts easier. This way if the US Coast Guard intercepts a boat load of drugs coming from Mexico in international waters heading presumably to the US it can still arrest the smugglers even though they haven't entered US waters yet. It's because the drugs are illegal in both countries and to the same degree because the United Nations is the one deciding what schedule they are. Anyone doubting this only has to go to the United Nations drug interdiction web site to find this out. The problem with this treaty is that the federal government entered into an agreement it can't enforce due to the fact that it has no say in how the individual states deal with contraband.
