As a fellow Aussie, and a lawyer specialising in Constitutional & Public International Law, I'm more than a little surprised at Ms Pletka's surmise that "Hillary Clinton arguably committed pretty serious violations of the Espionage Act herself". Doubling down, she then suggested that the only reason this could not be established was because a portion of the offending emails had already been deleted from her server … as if Clinton had sorted through them all and deliberately deleted thousands of communications that somehow contained classified state secrets, rather than her own personal comments (including some occasionally undiplomatic remarks) that ran through the thousands of remaining emails. The fact that NONE of the FBI or other security analysts tasked with examining her emails found ANY evidence of dissemination (or deletion) of classified material seems lost on Ms Pletka.
I don't know where Ms Pletka received her legal training, if she has any, but I feel she completely misunderstands the governing laws in this case. While Clinton (quite inappropriately) used her own unsecured device to communicate – including on some (unclassified) matters of state diplomacy, this is a FAR CRY from what Trump is alleged to have done: Ie, gathering CLASSIFIED INTELLIGENCE documents – including plans of the HIGHEST SECRECY level; storing them in locations so insecure that they were potentially compromised; denying that he had them; and refusing to return them, even when under subpoena to do so.
I can quite understand why Trump and his supporters might wish to draw parallels between Hillary's emails and the allegations concerning Trump; but I can NOT understand why any impartial journalist could make the same mistake. In reality, there is simply no comparison.
