Amazon is screwed. Even if Amazon wins in court, Amazon will loose millions in legal fees, brand reputation, stock value, and face unending scrutiny from law enforcement and Congress. Amazon's general counsel is David Zapolsky, whose only expertise is in white collar defense, doesn't know what he is doing in this area of law.
