Bad journalism and bad legal “expert”. The doctor just didn’t use the right legal language but it doesn’t matter what language is used, what matter is the substantive issue — whether the abortion is medically reasonably necessary. Clearly, based on what we know about Cox’s health, it is. The doctor is just too chicken to perform the abortion. The court isn’t prohibiting the abortion, it’s just punting back to the doctors which is what the law specifies. The court is saying “don’t ask me what is medically necessary, I’m not a doctor and the law isn’t requiring me to make a medical decision.” Stupid ABC analysis . Get real experts on the story.
