  8. 'Put him on the ballot and let the voters decide' is a flawed argument.

    The constitution has three qualifications and one disqualification for the president.

    The Qualifications are that the President must:

    1. Be at least 35 years of age.

    2. Be a natural born citizen.

    3. Must have lived in the United States for at least 14 years.

    Disqualification:

    Article 3 of the fourteenth amendment which is referred to as the insurrection act.

    The absence of the qualifications is just as disqualifying as the disqualification. If a person is less than 35 years of age and he is placed in the ballot and elected by a majority of the electors, his presidency would be invalid and he would not be able to serve as president even though the people voted for him. The same for the other two qualifications.

    If people wanted to vote for a person who does not qualify to be president, the way to accomplish that would be to amend the constitution to remove those requirements. Only then would their votes for him count to elect him as president.

    Just like that, if a person is guilty of having participated in an insurrection, after having sworn to protect it, the only way to put him on the ballot and vote for him would be for the constitution to be amended or for congress to vote to remove that disqualification for a specific person. (This is in section 3 of the 14th amendment).

    If this is not done and he is placed on the ballot and people vote for him, his presidency would be in violation of the constitution and hence invalid.

    With respect to Trump, the only question that has to be answered is did he or did he not participate in an insurrection? If the answer is yes, then even if the whole country votes for him, his presidency would be invalid, and we would have placed the choice of the people above the constitution.

    My name is Marcus Horton and I can't believe that all the lawyers and judges in the various cases involving kicking ex-president Trump off of the ballet don't know basic US federal constitutional law and the federal criminal and civil laws dealing with this area of law. I had to study these areas of law when I got my degree in American History from San Jose State University (for example History 171 Development of the American Constitution) and one has a violation of the 14th Amendment here because only Congress is allowed to enforce the 14th Amendment (Section 5). The area of federal criminal law violated is 18 USC section 241 which makes it a crime for two or more people to oppress any citizen in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States. One can find a civil law that goes with this area of law where individuals can sue for money. The money comes from the people violating the rights of the people wanting Trump on the ballet. You have to show under these laws that a reasonable person should have known due to court cases or laws that what he or she was doing was illegal at the time he or she was doing it. That is child's play to do. Article 6 of the US Constitution states that the US Constitution is the supreme "Law of the Land". This is the supremacy clause of the US Constitution which the US Supreme Court in Marbury v Madison stated rules over governmental actions. Number 1 the US Constitution is first. Number 2 is what is the position of the US presidency ? Is it a federal or state position? According to Article 2 the presidency is a federal position. Also according to this article the state chooses Electors who will vote for who will be president. Article 4 Section 2 states "The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States". Thus the names of which the Electors can choose from are also names from other states and that is why you have write in the name you want on ballets. If Trump is on the ballet in one state, then he has to be allowed on other states' ballets if he wants. By not allowing Trump on the ballet you are denying people the right to vote for who they want to while others elsewhere have that right. Number 3 has to do with Section 5 of the 14th Amendment. Did anyone read this section because it states that only Congress can enforce the 14th Amendment? It is a power not given to the states. Amendment 10 states that any power delegated to the United States by the Constitution is not a state power. Section 5 of the 14th Amendment states that it is a federal power of Congress thus a state can't use the 14th Amendment to bar someone from office at the federal level. Wrong branch of government. We have a separation of powers here. It is a federal government power here. The US Supreme Court in The Civil Rights Cases stated that Section 5 is for Congress to regulate the actions of state and local governments to the already existing rights people have. The Supreme Court stated in Katzenbach v Morgan that Section 5 can apply to elections. States do not have the right to decide if Trump violated Section 3 of the 14th Amendment or if he violated a state law barring him from the ballet due to riots in Washington because this is a federal area of law that only Congress can decide and was decided during his trial before Congress on the riots. He was found not to engaged in insurrection by Congress in his impeachment trial so any interference by state officials and others is illegal. The US Supreme Court in McCulloch v Maryland and in Osborn v Bank of the United States stated that states don't have the right to interfere with the federal powers as stated in the US Constitution.

    What I am asking for is that people ask the FBI and the Justice Department to look into these criminal events and put the people behind bars. Also let people know that they can sue people for money. The money lawsuits will make people think before doing things like this in the future. Also talk about what I wrote you to the news people and others. We need to get the word out.
