Removing Trump from the ballot is 100% an illegal move, and most ironically is itself a direct attack on democracy. There WAS NEVER A RESURRECTION ON JANUARY 6th, nor has the ex-President even ever been charged, let alone found guilty, of participating in an insurrection. The framers of the 14th Amd used the “beyond reasonable doubt” to effectuate the political disability barring “insurrectionist” from holding office. The thing is nearly all the 1861 insurrectionist accepted presidential pardons in lieu of 6th Amd jury trials/convictions. Judge John Underwood dismissed the jury trial against Jefferson Davis after Davis accepted a pardon from Andrew Johnson, thus barring Davis from holding office. That’s because when a pardon is accepted, the individual is admitting to the validity of the federal govt’s criminal charges against him/her as reaffirmed in Burdick v. USA Supreme Court decision. Interestingly, Davis and Robert E Lee (who also accepted a pardon thus admitting guilt in lieu of a criminal jury trial/conviction) had the political disability barring them from holding office by 2/3rds vote in congress and signed by Gerald Ford over a hundred years later in the 1970s. Ford also exemplified that acceptance of pardons (even pre-trial pardons) are admissions of guilt when he pre-trial pardons Richard M Nixon.
