The other issue is that it was the pedestrian who narrowly misses. Since the pedestrian was where he/they/ver were supposed to be, the car would have narrowly missed the pedestrian.

You couldn't even see the car until 10 to 15 minutes later after the guy had passed by before the driver drove his car into the restaurant.
