It's a shame this is televised, really. Part of me appreciates the ability to see just how despicable some of these senators are, but I also can't help but wonder if there were no cameras for these buffoons to perform to, would they? It seems a lot of these senators are just using this platform to put on a show for their constituents, rather than actually vetting the nominee (in all these hearings).

We have real problems today because the purpose of what we do has been separated form the actions we do, like voting, where we have totally disconnected the act of voting from why we are voting. There are only two purposes for voting, either as a legislative assembly or to form a legislative assembly, when we vote as a legislative assembly that is a democracy, when we vote to form a legislative assembly that is a Republican Form of government.
Take this nomination to the Supreme Court, the purpose of this process, that we are calling a confirmation hearing, is totally disconnected from the purpose of a justice on the Supreme Court, or the purpose of the Court in general, which is important because that purpose of the court dictates how the court must be assembled, and makes this process totally inappropriate to that purpose.
The Supreme Court is to sit as the last court of appeals to settle conflicts and disputes between the States and to give the States a process to seek redress for their grievances. That means that each State must participate in assembling the court because they have agreed to abide by the decisions of the court which adjudicates those conflicts and disputes. This cannot be a partisan process, nor can the court have an ideological balance determined by partisans, and there must be more than one nominee for the States to consider and choose from in order to assure that those chosen for the Court are chosen by a majority consensus of the States.
The Supreme Court is not for determining any aspect of laws, because laws cannot be unconstitutional, to constitute means to form or assemble, and the only thing formed and assembled by the Constitution of the United States is Congress as a legislative assembly of the States governed by legislative processes to reach a majority consensus of the States as the Union, it’s how the States make the collective decisions of a free and independent State for matters of war, peace, alliances and commerce, which were extended from the individual States when they declared their independence from the State of Great Britain to the States as the Union by the Articles of Confederation. This made their assembly, the united States, in congress assembled, the Established Government Authority, and the Articles of Confederation is a participation versus compliance agreement between the States, but there still needed to be a conflict and dispute process to settle grievances, especially when the laws the States made collectively disenfranchised or otherwise disadvantaged one or more States even though they were made by a majority consensus of the States as the Union. This is why laws cannot be unconstitutional, only the assembly which made the laws or the process by which the laws were made can be unconstitutional.
I know this is a hard concept for most to understand, but the Supreme Court is not for determining the constitutionality of laws, because as long as the laws are made in a properly assembled legislature which follows the established legislative processes to reach a majority consensus of the States as the Union, then the law itself cannot be unconstitutional, the Supreme Court then is only to settle conflicts and disputes between the States and for the States to seek redress of their grievances, nothing to do with the law.
Here is an excerpt from Article 9 of the Articles of Confederation which established the court of appeals from which the Supreme Court was derived, its purpose, and how it was assembled, the only difference between this and the what is established in Articles 2 and 3 of the Constitution of the United States is that the President is responsible for providing the list of potential candidates for the States to consider, instead of each State providing a list of 3 persons, that alone should enlighten us why one nominee is not enough for the States as they are assembled in the Senate to consider, by and with their advice and consent.
Article IX Clause 2 of the Articles of Confederation
“The united states, in congress assembled, shall also be the last resort on appeal, in all disputes and differences now subsisting, or that hereafter may arise between two or more states concerning boundary, jurisdiction, or any other cause whatever; which authority shall always be exercised in the manner following. Whenever the legislative or executive authority, or lawful agent of any state in controversy with another, shall present a petition to congress, stating the matter in question, and praying for a hearing, notice thereof shall be given, by order of congress, to the legislative or executive authority of the other state in controversy, and a day assigned for the appearance of the parties by their lawful agents, who shall then be directed to appoint, by joint consent, commissioners or judges to constitute a court for hearing and determining the matter in question: but if they cannot agree, congress shall name three persons out of each of the united states, and from the list of such persons each party shall alternately strike out one, the petitioners beginning, until the number shall be reduced to thirteen; and from that number not less than seven, nor more than nine names, as congress shall direct, shall, in the presence of congress, be drawn out by lot, and the persons whose names shall be so drawn, or any five of them, shall be commissioners or judges, to hear and finally determine the controversy, so always as a major part of the judges, who shall hear the cause, shall agree in the determination.”
Maybe we should actually start reading our founding documents instead of using them as coffee table coasters as we form our own inappropriate interpretations to suit our own agendas and quests for power. Notice too that this is the same process that they chose to select the President and Vice President, each State provides a list of potential candidates, the lists are combined, then the States choose from the top candidates identified on the list, 1 vote per State, and a majority of the States is necessary to the choice.
