I must quibble with Andy McCarthy. The list of 100% below minimum, below prosecutor requests sentencing record in the limited-discretion child porn cases reflects a normative view (“if I wear the robe, I make the decisions”) of her job that some of her “Scalia-like” statements contradict. As an aside, Judge Jackson pulled the key punch in her discussion of her semi-Scalia-style views of Separation of Powers. Scalia explained that Separation of Powers is “gridlock by design” and “the core of American Exceptionalism”. No other country has US-style gridlock built-in. Judge Jackson likes clearly to “get things done”, whether in her positive law ken or not. There were some things she should have said in these hearings, and did not say, that may turn out to be more than inconvenient to her. In last year’s hearings too. Stay tuned.

Brown-Jackson appears to have worked hard to become an ethical and fair interpreter of justice, but this nomination has become too politicized about race and gender. No business can advertise only selecting candidates of a particular melanin content or choice of gender identity. It is an illegal nomination, period!
