It's called the Presidential Records Act, Maria. It does NOT allow or permit a former or sitting President to do anything he wants with routine or classified documents. All documents generated during his term are and remain the we the people's. The current President has access to all as our Chief Executive but is bound by protocol regarding Sensitive and Too Secret documents. All others must be preserved by him and his staff and immediately handed over to the exclusive custody of our National Archivist when the President leaves office under any circumstances. The sitting President may not tear up, burn, flush or eat(!) any of our documents.
The sitting President has broad powers to unilaterally declassify all documents except those involving U.S. nuclear secrets. He must consult with the agency that issued the document. This requirement can be satisfied by a brief phone call, so sweeping are the powers we've given our President. Neither Trump nor his lawyers have ever suggested he did this for the hundreds of documents he stole that were returned or retrieved in the raid or the contents of the 48-52 folders still missing.
While the Presidential Records Act of 1972 has no criminal penalties and relies on the honor of the President and staff for enforcement that is not true for the Espionage Act of 1918. That law does not even require the possession of Top Secret documents to be charged. Don't be surprised if Trump's S.S. detail is charged for aiding and abetting his theft, storage and re hiding to prevent their requested, subpoenaed and search warranted recovery.
Lastly, this lawyer realizes as well as you the government didn't cause any of these cases to be brought; Trump did. He's running in part to shield himself from the law. If he can delay through motions and get back in office by any means he will be above the law. Fox "News" is happy to assist in the smoke screen to provide cover and facilitate this.
Trump promises ..on day one" to weaponize the DOJ against Joe Biden; the very thing he accuses Biden of doing now. If you don't believe Biden is too principled not to use the DOJ in this way know he's too savvy. Why interfere? There's no upside to it. Biden has stayed out of it and why wouldn't he play it that way? "Never interrupt an enemy while he is making a mistake." Napoleon Bonaparte Trump not only undeniably did these acts he continues to confess. In this documents case he dropped the mistaken mishandling of staff or deliberate planting by the FBI. He claims he has a perfect right to them and by moving or thinking about them they became his. The Presidential Records Act says so he asserts. He relies on the poorly educated he so loves to be unable to read it or take his word. Stop lying about all this! Why don't you put our country first?
