California man freed nearly 3 decades after wrongful conviction



Gerarda Cabanillas spent 28 years in prison for a rape, robbery and kidnapping he didn’t commit. Now, thanks to DNA evidence, he’s free. KNBC’s Bailey Miller reports.

  5. Regardless out of all the money you can get it whoever was involved with the sentencing should be fired maybe even a fine cause no matter what the thing more valuable than life itself is time we never get it back what would happen to a regular person shouldn’t be different

  6. This is one of the reasons I oppose the death penalty. The other reason is i believe jail to be a far worse punishment.

  10. I believe any person who wrongfully accuses anyone of any crime. Should have to do the time that person did or was facing. It's so easy to ruin someone's life over lying.. good for this man, but that conviction overturn won't bring them years back..

  12. That just means the real person of this crime. 30 years ago is still possibly free. But not to worry one day the real suspect will die and he will stand in judgment before the ultimate judge like everyone will. How are you doing that day? Have you always bear witness to the truth of moral reality?

  13. I know everybody always says I have nothing to hide when talking to the police. And I have nothing against police officers. But this is the exact reason why you do not ever talk to a police officer without a lawyer present! Hopefully this was a hard lesson that he learned. We have this thing called the Constitution. Nobody uses it. I know you don't want to seem like that you're somebody who hates the police, but that's not what this means. You actually love the police and you love the law. This is why you do not speak to them without a lawyer present.

  21. There something I do not understand about your justice system, how can a person be jailed without a matching evidence and you guys says we are in democracy…what is that? I can't comprehend it in any way. Is it same old badness or what? Just asking.

  23. This poor guy got robbed thirty years of his life. He deserves major reparations. Everyone that failed this poor should be sued for every last penny. How do you convict someone with no concrete evidence at ALL? Absolutely useless.

  32. How does it take almost 30 years to free an innocent man?, because the system says one thing and does another, innocent until proven guilty is not the reality.

  33. He should be compensated for 28 years of missed income. So at least the remainder of his days can be spent free of worry.

  39. These things are good enough!! I know there are more in prison just like him!! Give him his massive check and let him start his life. He’s lost his whole life.

  40. He needs to file suit and give him a few million $ for restitution of a false imprisonment.

  41. They need to pay that man for the rest of his life for demolishing his life
