The Colorado Republican Party is asking the U.S. Supreme Court to overturn a state ruling that disqualified former President Trump from the ballot. The state court found that Trump violated Section 3 of the 14th Amendment. NBC News’ Danny Cevallos explains the Colorado Republican Party’s arguments that will be brought to the Supreme Court.

READING THE PETITION FOR WRIT OF CERTIORARI BY tHE COLORADO REPUBLICAN, HERE ARE QUESTIONS PRESENTED UPON APPEAL: The Supreme Court of Colorado held that states possess authority, regardless of the lack of congressional authorization, to determine that a presidential candidate is disqualified under Section Three of the Fourteenth Amendment and that former President Donald J. Trump is disqualified as an insurrectionist. The three (3) questions we presented are: (1) Whether the President falls within the list of officials subject to the disqualification provision of Section Three of the Fourteenth Amendment? (2) Whether Section Three of the Fourteenth Amendment is self-executing to the extent of allowing states to remove candidates from the ballot in the absence of any Congressional action authorizing such process? (3) Whether the denial to a political party of its ability to choose the candidate of its choice in a presidential primary and general election violates that party’s First Amendment Right of Association?

REALITY CHECK: Colorado's Secretary of State offered up the idea of NOT removing Trump from the Ballot….but this was a ploy to try and get SCOTUS to NOT officially REVERSE Colorado's decision. THIS WILL FAIL because OTHER states (like Maine) have jumped on the "Remove Trump" bandwagon, and THAT will FORCE SCOTUS to render it's decision on Colorado's ruling anyway. Colorado offered this deal to try and head off SCOTUS REVERSING Colorado's ruling…because they are positive that SCOTUS WILL reverse the Colorado ruling. Had the OTHER states not jumped in on this, Colorado's ploy MIGHT have succeeded.
Looks like the DNC is gonna have to stick with the original strategy of ballot stuffing.
