Paying Daniels to keep her mouth shut about a lawful private act of sexual intercourse, using your personal funds, is not a violation of Federal campaign funds law. Bragg's case for a felony hangs on a judicial interpretation of the meaning of "promote the election by unlawful means" language found in the New Yok Election law section the indictment does not cite but which Bragg, in his press conference, acknowledged is the basis of his theory.
Certainly, Bragg's crowd researched the case law of New York, looking for any appellate decision which interpreted the statutory language in the context of factual situations. The question is, Does the case law support Bragg's theory? If I were to pay a government agent a bribe to burn a box containing precinct votes, or pay a person to vote twice, we have an easy case that falls within the meaning of the statue. What other obvious examples can you think of?
One circumstance, so far, has not been explained by Bragg's theory. Cohen made the $130,000 payment to the Bimbo before the November 2016 Election, and Trump wrote the first check made payable to Cohen for "Legal fees" in February 2017, three months after the Election and a month after being sworn in as President. So, as a matter of fact and law, when Trump violated the Penal statue the violating act, writing in the check register, cannot be said to have "promoted" his election. He was already elected. How does Bragg explain this fact away? It is not a violation of law for Trump's agent, Cohen, to pay the Bimbo "hush money" before the Election, and before the Election Trump did not violate either the Penal Code statue of the Election Fraud statue, Therefore, as of the date of the Election, Trump, having violated no laws, cannot be said to have promoted his election by unlawful means. How does Bragg counter this legal view of the matter?
