NERC will release their 2023 summer reliability assessment on May 17th. In a pre-release statement, NERC indicated that, “if summer temperatures spike and become more widespread, the U.S. West, Midwest, Texas and Southeast, New England and Ontario (in Canada) may experience resource shortfalls.” This is before existing power plants already slated for retirement are shut. The new rule assumes widespread ability to capture and sequester (i.e., store in the ground) carbon dioxide emissions from coal and gas power plants within the next 10-12 years. The infrastructure to do this cannot be built in time. Replacement nuclear generation (currently only 20% of US electricity from nearly 100 plants) cannot be built in time. The wind, solar, and batteries needed (along with tripling the grid infrastructure to deliver it) cannot be built in time (disregarding the high cost, diminished reliability, and constrained global supplies of raw materials). To say this will be expensive and painful is understatement of the highest degree, all to address the 3% of global CO2 emissions from the US power sector. Meanwhile Asia accounts for more than 50% of global emissions and will continue to build new coal power plants.

Perhaps the EPA "just forgot" about the Supreme Court case of West Virginia vs. EPA issued last June 30, 2022. You can rest assured Senator Joe Manchin has not forgotten that case. The EPA is going to have to show how their current rule proposals materially differs from the Court's very recent decision because they are definitely going to hear about it from multiple sources, including state's attorneys general.
