This is dumb. When you have overwhelming justification to imprison somebody before the trial, and nobody, literally nobody, thinks he'll follow the gag order, why bother with it?
Takes months for them to play footsie with this guy, and then they say 'oh no, all those illegal things you're doing, um, you're not allowed to do them anymore', and they think he cares?
He doesn't think they're going to enforce it in any way that actually affects him. He doesn't care what they say.
Unless they're willing to lock him up awaiting for the trial to conclude, then they're bluffing. He's going to call the bluff. If they're not willing to follow through, then their authority is dissolved.
If they are willing to follow through, then they've given him the option to flaunt their authority in the meantime, and given him the choice of when to cross the line so critically that they can't ignore it anymore. They give the initiative to him, to choose the time and circumstances under which things will happen. Strategically, this is rank incompetence, and being impartial is not the same thing as feigning ignorance. I don't think they're going to follow through. I think the courts are weak, and they're just proving that slowly. For 55 years he's treated courts as a joke and gotten away with it. Seems like he knows something the rest of us didn't.
