John Cornyn makes a good point. There is no constitutional right for the courts to substitute their opinions for that of the elected representatives. Its not an enumerated right, its an implied power. What Cornyn may be getting at is the fact the courts all to often abuse this power, as they have abused in in overturning landmark legislation such as the Voting Rights act and the Affordable Care Act. Clearly conservatives were abusing this implied power when seeing to dismantle those laws. The conservatives have little to no comprehension of our system of government. They view everything the government does as an exercise in power because thats what their desire is only for, power.
