So this new law that holds the criminal until trial. Does it mean our government the ones that are charged with a crime are they also denied cash bail .
As long as the judges factor in 'repeat offending' as to whether release or add more stringent terms, this is worth pursuing. Buying one's freedom? We all know what THAT sounds Ike…
I hope ending cash bail goes well. I knew someone who sat in jail for 30 days leading up to a trial that never happened because the charges were dropped. I also knew a guy who got a DUI and, for an extra $700, got to go to "hotel jail" for a series of classes and lectures on drunk driving instead of going to actual jail. That's not fair to the folks who don't have $700 – and, if the lectures actually do any good, it's also no fair to society because it puts the jailed driver back on the roads without the benefit of those classes.
I don't think there's any place for money in our justice system. I think prosecutors and defense attorneys should all be equally well funded and that any exchange of money – fines, bail, legal fees, canteen accounts, etc. – should be abolished. Money shouldn't buy you a better outcome in the justice system. The presence of money in the system automatically privileges the rich and produces a hardship not just for poor defendants, but for their families.
The courts are to blame, they do not punish criminals and civil defendents making a example of them to prevent further acts.
