My birth mother was an alcoholic and my brother and I were adopted off the reservation. I had a magical life and (even though I met my mother and most brothers/sisters) never looked back. So glad I had all the privileges I did.

It's not a race case. Native Americans are a sovereign nation, like their own country, and they get to decide whether their children can be adopted and by whom. The US government should not have any part in that. They are not classified as a race, they are a nationality. Therefore, there can be no racial discrimination that a white person can't adopt one before their own nations' people have the opportunity.
Imagine stealing a child, with the express purpose of cultural assimilation and what is, in effect, cultural genocide, then claiming that a law that seeks to counteract those genocidal effects by letting them remain within their culture is "unconstitutional and discriminatory". The ICWA doesn't even achieve justice, those parents who had their children taken away never saw them again, the ICWA merely tried to remove the genocidal motivation for taking children away in the first place.
