The executive branch did not lend the money. The executive branch does not have legal authority to forgive it. Congress owns the purse strings. This is so blatantly obvious.
It's a contract. The courts are loathe to interfere. The only question is if it's government loans. Someone in government has that authority. I'm guessing it's the body that authorized the loans to begin with. I'm guessing congress. This could be interesting. If the courts say congress ceded controll to a cabinet level department when it approved the federal student loan act in 1993. That likely means the president can, since it's a department under the executive branch. Really may depend on the language in the original law. It may also be the case that congress is not obligated to fund the program. Which I'm assuming is the case. Because otherwise the law would be unconstitutional? Anyway, it would be a boon if this resulted in the department of education having it's budget slashed. Not holding my breath though.

Student loans are canceled all the time. They just canceled billions of dollars in student loans for public service workers.
I'm not understanding why the owners of a student loan company won't demand at least $10 a month from each of the 48 million borrowers. With a basic cloud dashboard for each borrower to manage their account and a banking relationship to accept these payments, the student loan company can avoid huge staffing expenses. Seems like no employees are even needed to run such a company. Statements can be all electronic- no mailings, unless necessary. Therefore, most of that $10 * 48 million would be pure profit. A $10k reduction is not much. The problem is the interest building on the loans. This sounds like the legal weed problem. Now, that weed is legal, do they let people out of jail and prison? Should the borrowers that paid their loans be given a rebate or refund in an equal amount? Or, should they just be grateful they don't have any debt.

The truth of the matter, Rep. Nancy Mace, is that there isn't anything unfair about the Biden initiative to cancel student loan debt because it amounts to little more than deleting loan data since the federal funding process for these student loans ultimately originate through the process of quantitative easing (QE), as does all federal funding since the 2008 financial shakedown and the subsequent passage of QE3. For those Americans who are unaware of the process of QE spending, it describes the process of we the peoples' monies being electronically generated in order to meet any and or all federal expenditures when there are insufficient funds available from our defunct federal income tax system that will never, can never be revived. Then too, there is the fact that these monies cannot be "borrowed" or "paid back", for that matter, because we the peoples' monies were and are again, electronically generated.
Bottom line, President Trump and the Right have been out politicked, and what he and the Right should have immediately done and can still do, is that they should have endorsed this spending while stating that it doesn't go far enough which it does not go far enough. The Right has got learn is that this idiocy of shoveling TRILLIONS of we the peoples' electronically generated (QE) $s into the laps of the elite has got to stop. They elite in the future will have to learn how to "earn" we the peoples' monies and if a few, here and there, go bust, that's just too bad.
Something else President Trump has got to do before the 2024 general election is that he absolute must endorse having a Medicare For All comprehensive healthcare system that covers every single American without one cent of out-of-pocket expense and this system can and will be funded with we the peoples' electronically generated (QE) monies which means not one cent of federal tax revenue is involved.
